    The process for calculating and reporting passive activity losses on Form 8810 involves determining if the taxpayer materially participates in their activities, figuring net rental income, deducting real estate taxes and depreciation expenses, computing adjusted net loss from activities that aren't passive, and finally applying loss limitation rules.

  • How are passive losses limited?

    Passive losses cannot exceed the taxpayer's total income from active sources and passive sources. Losses from passive activities that generate less than $250 of income can be dedcted directly from other income, but losses from passive activities generating more than $250 of income must be calculated using Form 8810.

There are seven tests to determine material participation, including being involved in the activity for more than 500 hours during the tax year or being involved in managing the day-to-day activities of the business.
